Membership Agreement for Waterside at Grand Lake

All membership applications will be reviewed and are subject to management approval.

Memberships are limited and applications will be prioritized based upon first come, first served basis.

MEMBERSHIP COSTS

Memberships will require a one-time sign-up fee of $500.

The cost of an annual pool membership is as follows:

 

Single Membership: $600 paid in 12 equal installments of $50,

 

Couple Membership: $1020 paid in 12 equal installments of $85, and

Family Membership: $1620 paid in 12 equal installments of $135.

The cost of annual memberships are expected to increase in subsequent years. Any increase in the cost of an annual membership will be communicated to members a minimum of 60 days in advance of new price going into effect.

Members are responsible for ensuring payment method is valid and up to date.

Late payments will result in immediate suspension of membership until account is in good standing.

Memberships with an outstanding balance for a duration of 30 days or more will incur a $50 reinstatement fee. Memberships with an outstanding balance of 60 days or more are subject to cancellation by management.

Memberships with recurring late payments are subject to non-renewal, cancellation and additional administrative fees.

Members will be granted access to the amenity using the GymMaster app to unlock designated access point.

Key fobs may also be utilized to gain access and are available for purchase at a cost of $20 each.

CANCELLATION OF MEMBERSHIP

Management reserves the right to suspend or cancel a membership at any time for violation of any of the listed pool rules and regulations.

Cancellation of membership must be made in writing 30 days in advance of next scheduled payment (see terms and conditions). Any outstanding balances will be collected in full upon receipt of cancellation request. Upon successful processing of payment for remaining balance a cancellation notice will be issued to requestor.

Failure to pay any remaining balance will result in additional fees. Every attempt will be made to collect outstanding balances including but not limited to selling the debt to a collections agency or taking legal action to seek payment.

Should a membership be cancelled for any reason, the sign-up fee will be forfeited and any remaining balance will be immediately collected. No refunds will be issued.

Cancellation of a membership will result in forfeiture of sign-up fee and require a 12 month waiting period to re-apply for membership.

Each individual listed on a membership with an outstanding balance will not be allowed on the premises until balance is paid in full. This includes use of the gym, restaurant, bar, venue space or attendance at any special event.

Waterside at Grand Lake Rules and Regulations

The following Rules and Regulations for the Grand Lake Club pool are for the enjoyment and safety of the club users. Policies, rules and regulations are subject to change at the discretion of management or designated representative. Video surveillance will be utilized to monitor activities and enforce pool rules and regulations.

All participants must sign a waiver and acknowledge the pool rules and regulations before being permitted access to the pool area. All persons using the pool do so at their own risk. The Grand Lake Club will not be responsible for any accident or injury in connection with using the facility.

Members and guests must enter through designated entry access points using their assigned membership app or key fob. Members are not allowed to share, reassign or transfer login credentials or key fob.

Lifeguards are not on duty at the pool. Members are responsible for their personal safety and the safety of dependent minors or guests.

All members must adhere to posted signs and attendants instructions or requests at all times.

Pool may not be staffed during all hours of operation. Should a problem arise, contact information will be posted. If medical attention is required, contact 911 immediately.

All personal injuries, regardless of how slight, must be reported to a member of staff. Incident Forms can be found in the pool office.

Outside food or beverage (with the exception of Infant formula/breastmilk) is NOT permitted in the pool area. Food and beverage is available for purchase through the Grand Lake Club. Requests for medical exceptions will be granted with proper documentation.

Firearms, weapons, illegal substances, tobacco products are prohibited on Grand Lake Club premises.

The Grand Lake Club is a smoke free establishment. Smoking is strictly prohibited on the premises including sidewalks, parking lot, lawn areas and porches. This includes but is not limited to tobacco products and the use of electronic cigarettes, and vape pens.

No glass or breakable items are permitted in the pool area.

No pets are permitted in the pool area.

Persons under the influence of intoxicants will be denied access to the pool area.

The Grand Lake Club is not responsible for any lost, stolen or damaged items.

Admission may be refused to anyone appearing with colds, coughs, inflamed eyes, contagious infections or conditions which require bandages.

Children under the age of 16 MUST be accompanied by an adult at all times, regardless of their swim ability.

Children who are not potty trained must wear a swim diaper in the pool at all times.

Parents are solely responsible for the conduct of children using the facility.

No running, pushing, or causing undue disturbances in or around the pool area.

Throwing any objects that could result in injury (including footballs, frisbees, etc.) in or around the pool area is prohibited.

The use of profane or vulgar language and obscene gestures are strictly prohibited.

Language that discriminates based on race, gender, sexual orientation, disability, social origin, or any other subject in our sole discretion will not be tolerated.

The leadership team and employed staff have the authority to enforce any safety rules including limiting pool access to anyone deemed to be disturbing the enjoyment of others or risking injury to self or others.

The pool area will be cleared during all thundershowers and any other inclement weather situations when there is a risk to the club users.

All trash must be deposited into a trash receptacle.

Items left overnight will be discarded.

The relaxation area of the pool located between the entry steps and lane divider is reserved for adult guests over the age of 21. No splashing, rough horseplay, loud or disturbing activity is permitted in this area.

No user shall take any property belonging to the club from the pool area. Removal of property will be considered theft and appropriate legal action will be taken.

Members are responsible for the cost of replacement of any property of the Grand Lake Club resulting from vandalism, misuse, theft or neglect of said property.

The pool may close without notice at the discretion of the pool attendant for maintenance, weather conditions, private events, safety concerns or other unforeseen circumstances.

Appropriate swimwear (as determined by the Grand Lake Club at its sole and absolute discretion) is required at all times in the pool area. See-through swimsuits, thongs, items containing offensive images or language are not allowed.

The pool hours are strictly enforced and may be subject to change at short notice at the Grand Lake Club’s sole discretion.

Pool furniture including lounge chairs, dining tables, dining chairs, side tables, and umbrellas should not be moved from their original locations. Should you need assistance, please ask a staff member to assist you.

Please be considerate of others and do not reserve extra lounge chairs or seating by placing items on them for extended periods of time when not in use. Do not place items on more chairs than the number of people who arrive with you. If a chair is left unattended for a period of one hour, pool staff will remove items from the chair and place the items in a secure location so that others can enjoy seating.

When the splash pad is in use, members are prohibited from covering fountain openings impeding water flow and are responsible for any damages which may result from this action.

Lap lanes are reserved for continuous swimming. Members are asked to keep the two swim lanes closest to entry stairs open during pool hours. Children may be asked to perform a swim test before being admitted to the lap pool.

Floatation devices are not permitted in swim lanes.

Shaded seating areas may be reserved for groups or private events and may not be available to members during these times.

SLIDE RULES

Slide users must follow all rules pertaining to the slide usage.

The slide may only be used when an attendant is present.

All users must go down the slide feet first.

No running, standing, kneeling, rotating, tumbling, or stopping is permitted on the slide.

No horseplay on or around the slide.

No use of the slide shall occur while the rider is under the influence of any intoxicants.

Only one person is allowed on the slide at a time unless a parent or guardian is accompanying a minor in which case the two must remain in contact with one another.

Once a user has exited the slide into the pool, they must immediately move clear of the slide exit to allow clearance for the next user.

Users must not enter the slide until the slide is clear at the exit into the pool.

The use of inflatables or mats on the slide is prohibited.

Users must proceed up the walkway to the slide in an orderly manner. No running or passing other slide users will be tolerated.

Attendants reserve the right to restrict a member’s use of the slide for failure to follow slide rules or due to safety concerns.

Attendants reserve the right to close the slide for any reason.

The pool bar and snack bar hours will vary . A valid government issued ID will be required to purchase alcohol. A credit card will be required to open a bar tab or snack bar tab. Any tab left open at the conclusion of the day will be closed out and a 25% gratuity will be added.

Pool memberships include access to common areas confined within the fence line. Pool memberships do not guarantee access to reserved seating under the pavilion, restaurant/dining area, locker rooms, gym, bar or venue spaces.

Pool members are not permitted to access the restaurant, outdoor dining area, indoor restrooms or interior of club house wearing swimsuits or wet clothing. Prior to entering the building, individuals must be fully clothed in dry garments and wearing shoes.

Guest Passes are available and subject to the following conditions.

a. Member must be 18 or older to sign in and accompany guests. Members can purchase guest passes for a fee of $10 per guest.

b. Members are responsible for the actions of their guests, ensuring guests follow all rules and guidelines, and any unpaid balances left by guests.

c. One membership (whether individual, couple or family) may bring up to four guests as part of that membership at one time. Larger groups will be considered a private party and must be approved by the Club Manager in advance.

d. Unaccompanied guests are not permitted.

e. Guests must sign a liability waiver and sign in at the designated check-in area.

f. Guest passes are limited and based upon availability. Guest passes may not be available on high demand days such as special events or holidays.

g. Guests under the age of 18 must be accompanied by an adult with a membership at all times.

h. The same guest may visit up to four times per year regardless of whom the guest was accompanied by.

Members are not allowed to bring guests whose membership was cancelled by Grand Lake Club management.

Rude, threatening, aggressive or inappropriate behavior directed at pool employees, members or guests will not be tolerated. Please report any such behavior to pool staff immediately.

Please report any concerns, grievances or disturbances directly to the management team. Please refrain from publicly criticizing the Grand Lake Club facilities. If you are dissatisfied with your membership, please contact the Grand Lake Club management.

GRAND LAKE CLUB TERMS AND CONDITIONS

The Grand Lake Club Terms and Conditions ( “Agreement”) is an agreement between The Grand Lake Club (“The Grand Lake Club,” “we,” “us,” or “our”) and you, individually, or the entity you represent (“you”) and contains the terms and conditions that govern your access to and use of The Grand Lake Club pool, the contents and materials available, and any software we provide to you to access or interface with the GymMaster system, (collectively, the “Services”). This Agreement applies to your access to and use of the Services.

This Agreement takes effect when you click a “Login” or “I Accept” button or a checkbox presented with these terms or, if earlier, when you use any of the Services (the “Effective Date”). You represent to us that you are lawfully able to enter into contracts. If you are entering into this Agreement for an entity, you represent to us that you have legal authority to bind that entity.

Subject to the terms of this Agreement, we hereby grant you a limited, revocable, non-exclusive, sub-licensable, and non-transferable license to have access to and use the Services solely in connection with, and within the scope and purpose of, your business relationship with The Grand Lake Club.

The Services and all of the data and information in the Services are the confidential and proprietary information of The Grand Lake Club. You may use the Grand Lake Club pool only in connection with your use of the Services as permitted under this Agreement. You will take all reasonable measures necessary to avoid disclosure, dissemination or unauthorized use of Grand Lake Club Services and information. When this Agreement terminates, you can no longer use the Grand Lake Club Services or information.

You may not, and may not permit any third party to, use the Services in any manner or for any purpose other than as expressly permitted by this Agreement. You may not, or may not attempt to, and may not permit any third party to: (a) modify, alter, tamper with, copy, translate, or otherwise create derivative works of the Services; (b) reverse engineer, disassemble, or decompile the Services; (c) resell or sublicense the Services; (d) use the Services in a manner that interferes with other users’ use of the Services; or (e) use the Services in any manner that violates our Policies. All licenses granted to you in this Agreement are conditional on your continued compliance with this Agreement, and will immediately and automatically terminate if you do not comply with any term or condition of this Agreement.

As between you and us, we own and reserve all right, title, and interest in and to the Services. This Agreement does not grant you any rights in or to the Services except for the limited rights to use the Services expressly granted by this Agreement. We may change or remove features or functionality of the Services at any time.

We shall be the exclusive owner of all right, title, and interest in and to any data that you enter into the Services and all data derived from such data. You warrant that you have the legal authority to disclose such data to us for our use, collection and/or disclosure for the provision of the Services and such other purposes set out in any other agreement with us. Our Privacy Policy defines the processing of your personal data.

This Agreement shall commence on the Effective Date which will become your annual membership date. Membership will automatically renew each year and will continue thereafter until terminated as set forth in this Agreement (See Membership Contract).

If the required twelve month period of this Agreement has been fulfilled, you may give notice of cancellation by letter, delivered by a nationally recognized delivery service to us at the following address: The Grand Lake Club, 815 Southbridge Blvd, Savannah, GA 31405. Notice to us shall be deemed given when received by us.

Suspension. We may suspend your right to access or use any portion or all of the Services immediately upon notice to you if we determine: (a) your use of the Services may subject us, our affiliates, or any third party to liability or may adversely impact the Services or the systems of The Grand Lake Club pool ; or (b) you are in breach of this Agreement or any other agreement you may have with The Grand Lake Club. Our right to suspend your right to access or use the Services is in addition to our right to terminate this Agreement.

Termination. This Agreement automatically terminates at the time your business relationship with The Grand Lake Club terminates. In addition, we may also terminate this Agreement immediately, without liability, and by giving notice of the termination by sending a message to the e-mail address associated with your account if: (i) you have breached any portion of this Agreement or any other agreement you may have with The Grand Lake Club; (ii) your use of or access to the Services inhibits any other user from using or accessing the Service; or (iii) any part or all of the Services will no longer be offered. We may also terminate this Agreement at any time and for any reason by providing you with written notice. Upon termination of this Agreement, your rights to use the Services and The Grand Lake Club information immediately terminate.

YOU ARE RESPONSIBLE FOR ALL USE AND ACTIVITIES ASSOCIATED WITH OR ARISING FROM ANY USE OF YOUR ACCOUNT. WE AND OUR AFFILIATES ARE NOT RESPONSIBLE FOR UNAUTHORIZED ACCESS TO YOUR ACCOUNT IF YOU HAVE FAILED TO TAKE APPROPRIATE STEPS TO PROTECT YOUR ACCOUNT. You will contact us immediately if you believe an unauthorized third party may be using your account or if your account information is lost or stolen. You will be deemed to have taken any action that occurs under your account. You agree to keep your password secret and not to share it with anyone except as may be expressly allowed under this Agreement.

IN NO EVENT SHALL EITHER THE GRAND LAKE CLUB, ITS AFFILIATES, SUPPLIERS OR LICENSORS BE LIABLE FOR ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR IN ANY WAY CONNECTED WITH THE SERVICES OR THE AGREEMENT, WHETHER BASED ON CONTRACT, TORT, WARRANTY, STRICT LIABILITY OR OTHERWISE, EVEN IF ADVISED OF THE POSSIBILITY OF ANY SUCH DAMAGES.

Nothing in this Agreement limits or excludes the liability of either party for (i) death or personal injury resulting from negligence; or (ii) any damage or liability incurred as a result of fraud or fraudulent misrepresentation; or (iii) any matter for which it would be illegal to exclude or limit or to attempt to exclude or limit its liability.

You will defend, indemnify, and hold harmless us, our affiliates, suppliers and licensors, and each of ours and their respective employees, officers, directors, and representatives from and against any claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to any third party claim concerning: (a) your use of the Services (including any activities under your account); or (b) your breach of this Agreement or violation of applicable law. We will promptly notify you of any claim subject to this Section, but our failure to promptly notify you will only affect your obligations under this Section to the extent that our failure prejudices your ability to defend the claim. You may: (a) use counsel of your own choosing (subject to our written consent) to defend against any claim; and (b) settle the claim with our prior written consent before entering into any settlement. However, we may also assume control of the defense and settlement of the claim at any time.

We may modify this Agreement at any time by posting a revised version on the GymMaster system, or by providing notice to you as set forth in this Agreement. The modified terms will become effective upon posting. By continuing to use the Services after the effective date of any modifications to this Agreement, you agree to be bound by the modified terms.

All communications and notices to be made or given pursuant to this Agreement must be in the English language. We may provide any notice to you under this Agreement by means of posting a general notice on our website, the GymMaster system, or by sending a message to the email address then-associated with your account. Notices we provide by the foregoing postings will be effective upon posting and notices we provide by email will be effective when we send the email. It is your responsibility to keep your email address current. You will be deemed to have received any email sent to the email address then-associated with your account when we send the email, whether or not you actually receive the email. This Agreement includes the Policies and is the entire agreement between you and us regarding the subject matter of this Agreement. This Agreement supersedes all prior or contemporaneous representations, understandings, agreements, or communications between you and us, whether written or verbal, regarding the subject matter of this Agreement. We will not be bound by, and specifically object to, any term, condition or other provision which is different from or in addition to the provisions of this Agreement (whether or not it would materially alter this Agreement) and which is submitted by you in any receipt, acceptance, confirmation, correspondence or other document. If the terms of this document are inconsistent with the terms contained in any Policy, the terms contained in this document will control.

PAYMENT

You authorize The Grand Lake Club and any related payment processing service provider it may engage to charge your credit card, or to debit or process payment through any other offered means, for any products or services you purchase through your use of The Grand Lake Club pool. You represent and warrant that you are the only one who will make payments, and you shall be responsible for any and all uses of your credit card, debit card, or any other payment means used in or under your name. Unless otherwise specified, any amounts paid to The Grand Lake Club are nonrefundable.
